TracksBuilder Terms of Service

TracksBuilder provides software and related websites that help users build worship track sessions (the “Service”). By accessing or using the Service, you agree to these Terms.

  1. 1) Eligibility & Accounts

    • You must be at least 16 (or the age of digital consent in your country).
    • If you create an account, you’re responsible for keeping credentials secure and for all activity under it.
  2. 2) Pre-Orders, Pricing & Refunds

    • Founder Pre-Order. Pre-ordering grants you a license to the initial v1 release and beta access when available.
    • Price. The founder price is a one-time purchase (displayed at checkout). Future major upgrades or add-on services may be separate.
    • Refunds.
      • You may cancel a pre-order any time before you receive beta access for a full refund.
      • After you receive beta access, you have a 14-day money-back guarantee. Refunds are issued to the original payment method.
      • Beta invites roll out in batches; timelines may change. If timelines materially shift, we’ll notify you by email and honor the refund policy above.
    • Payments. Processed by our payment provider (e.g., Stripe). We don’t store full card numbers.
  3. 3) License & Acceptable Use

    • We grant you a limited, revocable, non-transferable license to install and use the software for your own internal use.
    • Beta software is provided “as is”. Features may change; performance may vary.
    • During beta, we may enable flexible activation. Final licensing terms will be confirmed at launch.
    • Do not resell, rent, host, sublicense, or reverse-engineer the software.
    • You’re responsible for complying with copyright/streaming licenses for any audio you import.
  4. 4) Your Content & Third-Party Rights

    • You retain all rights in audio/stems you import.
    • You must have permission to use all materials in the Service.
    • We are not affiliated with Ableton or any multitrack providers; you’re responsible for their license terms.
  5. 5) Feedback

    If you send ideas or feedback, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction.

  6. 6) Software Updates

    We may push updates, bug fixes, or changes. Some updates may be required to continue using the Service.

  7. 7) Third-Party Services

    The Service may link or connect to third parties (e.g., Stripe, email tools). Their terms and privacy practices apply to their services.

  8. 8) Disclaimers

    THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

  9. 9) Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

  10. 10) Indemnity

    You agree to indemnify and hold us harmless from any claims arising out of (a) your use of the Service, (b) your content, or (c) your violation of these Terms or applicable law.

  11. 11) Suspension/Termination

    We may suspend or terminate access if you violate these Terms or harm the Service. You may stop using the Service at any time.

  12. 12) Changes to Terms

    We may update these Terms. We’ll post the new version with an updated effective date and, if changes are material, notify you by email or in-app.

  13. 13) Governing Law; Venue

    These Terms are governed by the laws of the United States of America.

Privacy Policy

TracksBuilder Privacy Policy

Effective date: September 24, 2025

This Privacy Policy explains how we collect, use, and share information when you visit our website(s), join the waitlist, place a pre-order, or use our software.

  1. 1) Information We Collect

    • You provide: name, email, church/organization (optional), payment details (handled by our processor), messages/support requests, feedback.
    • Automatically: device/OS info, IP address, approximate location, pages visited, product usage events (e.g., build actions, errors), crash logs.
    • From third parties: payment confirmations from Stripe (or similar), email delivery status from our email service.
  2. 2) How We Use Information

    • Provide and improve the Service (including beta access and updates).
    • Process purchases, refunds, and customer support.
    • Send transactional emails (receipts, onboarding, product updates).
    • Send marketing emails only if you opt in (e.g., waitlist/newsletter).
    • Monitor performance, prevent abuse, and comply with legal obligations.
  3. 3) Legal Bases (EEA/UK users)

    We process data based on: contract performance (providing the Service), legitimate interests (product improvement, security), consent (marketing emails/cookies), and legal compliance.

  4. 4) Cookies & Analytics

    We may use essential cookies for login and security, and optional analytics (e.g., privacy-respecting event analytics). Where required, we’ll request consent. You can manage cookies in your browser.

  5. 5) Payment Processing

    Payments are handled by Stripe (or another listed processor). We receive limited information (e.g., last 4 digits, status) but do not store full card details. Your use of Stripe is subject to their privacy policy.

  6. 6) Sharing of Information

    We share data with service providers who help us operate the Service, such as payment processors and email/waitlist platforms. These providers are contractually required to protect your data and use it only on our instructions. We do not sell your personal information.

  7. 7) Data Retention

    We keep data only as long as necessary for the purposes above, then delete or anonymize it, unless longer retention is required by law (e.g., tax/audit).

  8. 8) Security

    We use reasonable technical and organizational measures to protect data. No method of transmission or storage is 100% secure.

  9. 9) Your Choices & Rights

    • Opt-out of marketing: use the unsubscribe link in emails.
    • Access/Correct/Delete: email support@tracksbuilder.com to request a copy, correction, or deletion of your data.
    • EEA/UK/Switzerland: you may have rights to data portability and to object/restrict certain processing.
    • California (CCPA/CPRA): you may request access and deletion and opt-out of certain sharing. We do not sell personal information.
  10. 10) International Transfers

    If we transfer data outside your country, we’ll use appropriate safeguards (e.g., SCCs for EEA→US transfers) where required.

  11. 11) Children’s Privacy

    The Service is not directed to children under 16. If you believe a child provided personal data, contact us to remove it.

  12. 12) Changes to this Policy

    We may update this Policy from time to time. We’ll post the updated version with a new effective date and, for material changes, provide notice.
