TracksBuilder Terms of Service

TracksBuilder provides software and related websites that help users build worship track sessions (the “Service”). By accessing or using the Service, you agree to these Terms.

  1. 1) Eligibility & Accounts

    • You must be at least 16 (or the age of digital consent in your country).
    • If you create an account, you’re responsible for keeping credentials secure and for all activity under it.
    • If you create an account, download a lead magnet, or otherwise provide your name and email, you agree to receive TracksBuilder product, onboarding, educational, and promotional emails where permitted by law. You can opt out at any time via the unsubscribe link or by emailing support. Transactional account, billing, security, and support emails may still be sent when needed to provide the Service.
  2. 2) Subscriptions, Pricing & Refunds

    • Subscriptions, trials & tiers. TracksBuilder is offered as a subscription with tiers such as Solo and Teams (and any legacy or promotional plans shown at checkout). New app accounts may start a no-card free trial through Stripe when they sign in or create an account in the app. Trial length, device limits, and plan details are shown in-product, on the account page, or at checkout.
    • Billing & renewals. Subscriptions are billed monthly or annually (as selected at checkout) and renew automatically unless you cancel.
    • Manage or cancel. You can manage your plan and cancel renewal in your account settings (including via our billing portal). Cancellation stops future renewals; access continues through the end of the current billing period unless otherwise stated at checkout.
    • Legacy / pre-orders. Some customers may have a pre-order or legacy purchase from earlier beta periods. If you have a legacy plan, your receipt and account page reflect the terms that apply to you.
    • Refunds. Unless required by law, subscription charges are non-refundable. For any legacy pre-order programs, refund terms (if available) are described at checkout and/or in the receipt email.
      • If you believe you were billed in error, contact support and we’ll investigate.
      • Refunds (when granted) are issued to the original payment method.
    • Payments. Processed by our payment provider (e.g., Stripe). We don’t store full card numbers.
  3. 3) License & Acceptable Use

    • We grant you a limited, revocable, non-transferable license to install and use the software for your own internal use.
    • Beta software is provided “as is”. Features may change; performance may vary.
    • Your subscription or trial may include device limits. We may require account sign-in, entitlement checks, and device activation to continue using paid or trial features.
    • Do not resell, rent, host, sublicense, or reverse-engineer the software.
    • You’re responsible for complying with copyright/streaming licenses for any audio you import.
  4. 4) Your Content & Third-Party Rights

    • You retain all rights in audio/stems you import.
    • You must have permission to use all materials in the Service.
    • We are not affiliated with Ableton or any multitrack providers; you’re responsible for their license terms.
  5. 5) Feedback

    If you send ideas or feedback, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction.

    We may also use feedback you provide through the app, website, or email as testimonials or promotional content for TracksBuilder, typically using a pseudonym and the role you’ve provided. We will not publish your email address or other direct identifiers without your permission. If you prefer we don’t use your feedback publicly, contact support@tracksbuilder.com.

  6. 6) Software Updates

    We may push updates, bug fixes, or changes. Some updates may be required to continue using the Service.

  7. 7) Third-Party Services

    The Service may link or connect to third parties, including Stripe for billing and trials, Linear for support and bug reporting, PostHog for product analytics, email providers for transactional and marketing messages, Supabase for authentication and account data, and storage providers for opted-in diagnostics bundles. Their terms and privacy practices apply to their services.

  8. 8) Disclaimers

    THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

  9. 9) Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

  10. 10) Indemnity

    You agree to indemnify and hold us harmless from any claims arising out of (a) your use of the Service, (b) your content, or (c) your violation of these Terms or applicable law.

  11. 11) Suspension/Termination

    We may suspend or terminate access if you violate these Terms or harm the Service. You may stop using the Service at any time.

  12. 12) Changes to Terms

    We may update these Terms. We’ll post the new version with an updated effective date and, if changes are material, notify you by email or in-app.

  13. 13) Governing Law; Venue

    These Terms are governed by the laws of the United States of America.

Privacy Policy

TracksBuilder Privacy Policy

Effective date: July 6, 2026

This Privacy Policy explains how we collect, use, and share information when you visit our website(s), create an account, start a trial, download a resource, contact support, report a bug, or use our software.

  1. 1) Information We Collect

    • You provide: name, email, church/organization (optional), payment details (handled by our processor), messages/support requests, feedback, bug reports, and diagnostics you choose to include.
    • Automatically: device/OS info, app version, IP address, approximate location, pages visited, product usage events (e.g., setup, build, account, billing, and error events), crash signals, and limited diagnostics needed to operate and secure the Service.
    • From third parties: payment, subscription, and trial status from Stripe; authentication/account data from Supabase; support and bug-report issue status from Linear; analytics events from PostHog; and email delivery, unsubscribe, and preference status from our email service.
  2. 2) How We Use Information

    • Provide and improve the Service (including beta access and updates).
    • Process purchases, refunds, and customer support.
    • Send transactional emails (login links, receipts, billing, and account notices) and onboarding/setup messages.
    • Send product updates, onboarding sequences, educational messages, lead-magnet followups, and promotional messages where permitted. Creating an account or submitting a lead-magnet form may add your email to our TracksBuilder email audience. You can opt out at any time via the unsubscribe link or by emailing support.
    • Create testimonials and promotional content using feedback you provide (typically with a pseudonym and the role you’ve provided).
    • Monitor performance, prevent abuse, and comply with legal obligations.
    • Create, route, and resolve support requests, feedback, bug reports, and crash reports in Linear.
  3. 3) Legal Bases (EEA/UK users)

    We process data based on: contract performance (providing the Service), legitimate interests (product improvement, security), consent (marketing emails/cookies), and legal compliance.

  4. 4) Cookies & Analytics

    We may use essential cookies for login and security, and optional analytics through PostHog to understand website and app usage, onboarding, builds, errors, and billing flows. We avoid sending obvious direct identifiers or file/song/path details in analytics properties, and where required we request consent before using non-essential analytics. You can manage cookies in your browser.

  5. 5) Payment Processing

    Payments, subscriptions, customer records, billing portals, and free trial subscriptions are handled by Stripe (or another listed processor). We receive limited information such as customer ID, subscription status, trial status, plan, billing status, and card metadata such as last 4 digits when available. We do not store full card details. Your use of Stripe is subject to their privacy policy.

  6. 6) Sharing of Information

    We share data with service providers who help us operate the Service, such as Stripe for billing/trials, Supabase for authentication and account data, Linear for support requests, feedback, bug reports, and crash reports, PostHog for basic product analytics, email providers for messages and preferences, and storage providers for diagnostics bundles. These providers are required to protect your data and use it only to provide services to us. We do not sell your personal information.

    When you submit a bug report in the app, you can choose whether to include app logs and diagnostics. If included, we upload the diagnostics bundle to our storage provider and attach a time-limited download link to the related Linear issue so we can investigate the report.

  7. 7) Data Retention

    We keep data only as long as necessary for the purposes above, then delete or anonymize it, unless longer retention is required by law (e.g., tax/audit).

  8. 8) Security

    We use reasonable technical and organizational measures to protect data. No method of transmission or storage is 100% secure.

  9. 9) Your Choices & Rights

    • Opt-out of non-essential emails: use the unsubscribe link in emails or email support.
    • Some transactional emails (like login links and billing confirmations) are required to provide the Service.
    • Access/Correct/Delete: email support@tracksbuilder.com to request a copy, correction, or deletion of your data.
    • EEA/UK/Switzerland: you may have rights to data portability and to object/restrict certain processing.
    • California (CCPA/CPRA): you may request access and deletion and opt-out of certain sharing. We do not sell personal information.
  10. 10) International Transfers

    If we transfer data outside your country, we’ll use appropriate safeguards (e.g., SCCs for EEA→US transfers) where required.

  11. 11) Children’s Privacy

    The Service is not directed to children under 16. If you believe a child provided personal data, contact us to remove it.

  12. 12) Changes to this Policy

    We may update this Policy from time to time. We’ll post the updated version with a new effective date and, for material changes, provide notice.
